A Kano State High Court has issued an interim injunction, restraining the Central Bank of Nigeria (CBN), Accountant-General of the Federation (AGF), and the Revenue Mobilisation Allocation and Fiscal Commission (RMAFC) from withholding funds allocated to the 44 local governments in Kano State
The court’s order was prompted by a Motion Ex-Parte filed on November 1 by Ibrahim Muhammed, Chairman of the National Union of Local Government Employees (NULGE), and five concerned residents of the state.
The motion, filed through counsel Bashir Yusuf-Muhammad and Usman Bala-Salisu, expressed concerns over potential withholding or delay of essential allocations for local governance.
Justice Ibrahim Musa-Muhammad granted the interim injunction, emphasizing that the respondents – including the CBN, AGF, RMAFC, and commercial banks – should not withhold, delay, or tamper with the allocations from the Federation Account to the 44 local governments pending the hearing and determination of the Motion on Notice.
Specifically, the judge’s order stated: “By withholding, refusing to disburse or delaying to disburse, deferring or suspending the monthly allocation or in any way tampering with the allocation from the Federation Account to the 44 LGAs pending the hearing and determination of the Motion on Notice.”
The court also permitted the applicants to serve court processes on the respondents through Red Star Express Plc, Courier Service, as a special bailiff, ensuring effective service of court documents.
The matter has been adjourned until November 21 for a hearing of the motion on notice.
