A case of incest and statutory rape was recorded in Calabar, Cross River State, as a 48-year-old man, Mallam Adamu Ibrahim Umaru, was remanded in prison custody for allegedly raping and impregnating his 15-year-old daughter.
The incident occurred at the family’s residence, No. 27 Edem Odo Street, Calabar. Umaru, a native of Bundugudu Local Government Area of Zamfara State, is accused of having carnal knowledge of his underage daughter, resulting in her pregnancy.
During the court proceedings at Magistrate Court 1, presided over by Chief Magistrate Mercy Ene, the Police Prosecutor, O. S. Umoren, filed a motion seeking to remand the defendant in prison custody until the completion of investigations.
Umoren argued that the motion was necessary, citing Section 4 of the Police Act 2020 and the Cross River State Administration of Criminal Justice Law 2016.
However, the defendant’s counsel, Mohammed Shaibu, opposed the motion, stating that he was not duly served with the motion prior to the arraignment of his client.
After considering the arguments, Chief Magistrate Mercy Ene granted the motion, supported by eight paragraphs, and adjourned the case until December 3.
